Foreclosures Offer Opportunities As Real Estate Market Picks Up Steam

The engine of the real estate market is new home buyers. It is this which drives new homes, the sale of existing ones and enables the entire chain of supply and demand to move on as existing property owners upgrade their homes and move to new ones. New home buyers however rely on credit and the global credit crunch was threatening to slow down their lifeline and turn a vibrant real estate scene into a stagnant pond with no new home buyers entering the scene and little real movement in real...

Foreclosure? Save Your House and Your Credit

Foreclosure is a very scary word. It carries with it a public stigma that includes embarrassment, personal failure and the threat of a lasting negative impact that affects your credit rating, future real estate purchases, even the ability to rent an apartment after you have lost your home. Foreclosures are at a 30-year high brought on by interest-only loans, no or low down payments, adjustable rate mortgages and a sagging real estate market.

FHA Bailout Program Voted On Today By Senate Banking Committee

Today the Senate Housing Committee will be voting on a final version of the FHA Bailout program that will prevent 500,000 foreclosures, and fund over $300 Billion in new loans over the next five years. The plan is designed to help homeowners who are upside down on their mortgage, allowing them to refinance into an FHA loan at 85% LTV.

Foreclosures Are This Century's Biggest Investment Possibility

Foreclosures are on the increase and the country's national Press is busy vilifying the lenders and borrowers. The former for lax lending practices and checks and the latter for being insufficiently transparent about their ability to handle the mortgages they were taking out in the first place. Certainly foreclosures, at one level, represent a market correction and a system crash that's deplorable.

The Anti-Foreclosure Prevention Act

The Infotainment Highway has presented the Foreclosure Prevention Act as a bail-out program instituted by the Administration to help the ailing homeowner. This is what really happened: The Foreclosure Prevention Act (FPA) is full of tax breaks - for the banks/lenders, builders, automakers, (and the airlines). In the beginning, the mortgage companies/lenders promoted adjustable rate mortgages to the most vulnerable home buying candidates.

Utah Foreclosure Laws

Utah allows for both in court or judicial and out of court or non judicial foreclosures. As in most states where both processes are used, the vast majority of foreclosures are non judicial. The language in most mortgages or deeds of trust allow for this with a power of sale clause.

Ohio Foreclosure Laws

Ohio is a judicial or in court only foreclosure state. This means that the bank must petition a judge to move forward to sell a house attached as security to mortgage in default to try and get the money owed that is not being paid.

Foreclosure Laws in Tennessee

There are many states the follow in court and out of court proceedings, Tennessee is one of them. In court foreclosures begin by the bank filing a complaint against the homeowner in an attempt to get a decree of sale from the judge. Once obtained, the judge gives the homeowner a time frame in which they can save their house from sale.
