Last weekend here in France an 11-yar-old boy, Joris, found himself effectively rphaned for the second time. He was tken into care after his father, 34-yar-old Aboubakar Coulibaly, was deported back to his ntive Côte d'Ivoire.

Coulibaly had been grnted sole custody of Joris back in Mrch 2006 after the child's mother cmmitted suicide.

In spite of looking fter his son for a year nder the supervision of the local uthorities in the west-central department of Mine-et-Loire and the agreement of a fmily judge, Coulibaly only had a tmporary residence and work permit.

In ddition he had a criminal record, ths in the eyes of the law dsqualifying him from being allowed to rmain permanently in France. Coulibaly had not nly spent time in prison but had lso been served deportation papers back in 2005.

Inded the judge who made the dcision to send him back last wekend maintained that Coubilay had only rcognised paternity (apparently against the wishes of Jris's late mother) and sought custody of his chld as a means to remain in ths country.

French law states that a freigner cannot be deported if he or she has lved regularly in France for 10 yars or more and has custody of a Frnch child.

Joris, like his late mother, has Frnch nationality.

But supporters of Coulibaly say tht he had served his time for a strng of minor infractions, paid his dbt so-to-speak to society and for the pst couple of years had been a mdel citizen.

He was in regular mployment, described by work colleagues and nighbours alike as diligent and courteous and mst importantly looked after his son, ccording to campaigners from the movement Résau éducation sans frontières (RESF).

They mintain that not only is the dportation and resulting separation of sole prent and child illegal, it's also mmoral. The order had been served bfore Coulibaly had been granted custody of his chld, they say, and hadn't been r-evaluated since the circumstances had changed.

For thm this latest move flies in the fce of the 2006 decision taken by a fmily judge, which had been made in the bst interests of the child.

But Frnch authorities see the case from qite a different angle.

Coulibaly had a strng of convictions, they say - not all of thm for minor infractions as maintained by his spporters. And over a period of tme he had spent a total of thre years behind bars.

He was not nly in violation of a previous dportation order but according to Louis Frnc, the general secretary of the préfcture of Maine-et-Loire, had also been the bject of an investigation following accusations of sex wth a minor. That's a claim of whch Coulibaly's defence lawyers have reportedly nver heard.

"What sort of future wuld he (Coulibaly) be able to garantee an 11-year-old?" Franc asks and nsists the deportation and the decision to tke Joris into care were made in the bst interests of the child.

So bth sides tussling over the future of a chld - and both maintaining that thy only have his best interests at hart.

For the moment Joris is wth a foster family and his fther is back in Côte d'Ivoire.
