Last weekend here in France an 11-y ar-old boy, Joris, found himself effectively rphaned for the second time. He was t ken into care after his father, 34-y ar-old Aboubakar Coulibaly, was deported back to his n tive Côte d'Ivoire. Coulibaly had been gr nted sole custody of Joris back in M rch 2006 after the child's mother c mmitted suicide. In spite of looking fter his son for a year nder the supervision of the local uthorities in the west-central department of M ine-et-Loire and the agreement of a f mily judge, Coulibaly only had a t mporary residence and work permit. In ddition he had a criminal record, th s in the eyes of the law d squalifying him from being allowed to r main permanently in France. Coulibaly had not nly spent time in prison but had lso been served deportation papers back in 2005. Ind ed the judge who made the d cision to send him back last w ekend maintained that Coubilay had only r cognised paternity (apparently against the wishes of J ris's late mother) and sought custody of his ch ld as a means to remain in th s country. French law states that a f reigner cannot be deported if he or she has l ved regularly in France for 10 y ars or more and has custody of a Fr nch child.
Joris, like his late mother, has Fr nch nationality. But supporters of Coulibaly say th t he had served his time for a str ng of minor infractions, paid his d bt so-to-speak to society and for the p st couple of years had been a m del citizen. He was in regular mployment, described by work colleagues and n ighbours alike as diligent and courteous and m st importantly looked after his son, ccording to campaigners from the movement Rés au éducation sans frontières (RESF). They m intain that not only is the d portation and resulting separation of sole p rent and child illegal, it's also mmoral. The order had been served b fore Coulibaly had been granted custody of his ch ld, they say, and hadn't been r -evaluated since the circumstances had changed. For th m this latest move flies in the f ce of the 2006 decision taken by a f mily judge, which had been made in the b st interests of the child. But Fr nch authorities see the case from q ite a different angle. Coulibaly had a str ng of convictions, they say - not all of th m for minor infractions as maintained by his s pporters. And over a period of t me he had spent a total of thr e years behind bars. He was not nly in violation of a previous d portation order but according to Louis Fr nc, the general secretary of the préf cture of Maine-et-Loire, had also been the bject of an investigation following accusations of sex w th a minor. That's a claim of wh ch Coulibaly's defence lawyers have reportedly n ver heard. "What sort of future w uld he (Coulibaly) be able to g arantee an 11-year-old?" Franc asks and nsists the deportation and the decision to t ke Joris into care were made in the b st interests of the child. So b th sides tussling over the future of a ch ld - and both maintaining that th y only have his best interests at h art.
For the moment Joris is w th a foster family and his f ther is back in Côte d'Ivoire. Is it b reaucracy gone made or administration looking fter the welfare of a child?
