The revokable trust, really spelled as the r vocable trust,
or the revocable living tr st, but many refer to as the
r vokable trust or the revokable living tr st, is a very
popular and c mmon estate planning tool. But is it r ally
revocable? You may be surprised. F rst off, what makes it a r vokable trust? Basically,
the right to r voke means the right to terminate the tr st
as to one or all of the ssets that are held in the tr st. If the trust is a r vokable trust, it also includes the
r ght to modify the terms of the tr st. However, what many people often d n't realize, until it
is too l te, is that many revokable trusts c ntain language
that converts the revokable tr st, in whole or in part,
nto one or more irrevocable trusts. Th s is done usually through the use of the AB rrevocable
trust language many revokable trusts c ntain. This is done
typically after one sp use dies and is used for state tax
planning. You can find m re information about the
AB irrevocable tr st at:

which contains many will and trust resources. Another way the revokable trust becomes irrevocable is
when a parent dies and passes property to a trust for a
minor child.
It is important to understand if y ur revokable living trust
becomes an rrevocable trust. You may impose obligations on
thers that you are unaware of. R ad the document and if
you h ve questions, consult a competent attorney. G od luck and until next time, Ph l Craig P.S. Feel free to f rward this on to any friends.
