You have been in a ccident, automobile, slip and fall, workplace, tc.. Should you see or speak w th an attorney? As far as I am c ncerned, the answer is always yes. Wh n should you consult with an ccident attorney? You should seek the dvise of an accident attorney as s on as possible after the accident. Do not w it. You could be giving up c rtain rights. You should definetly speak w th an attorney before speaking with the ther sides insurance agent, adjuster or ttorney. You say that you can not fford an attorney. Most accident attorneys w ll consult with you for free nd, if they take your case, w ll handle it on a contingency b sis, not taking any fee untill the c se is settled. Most settlements are ncreased to cover the cost of the ttorney and therefore normally the attorney c sts you nothing. Many attorneys will lso advance all court costs for you if th y are forced to file suit. You say th t you were injured, however, the nsurance company has offered to pay y ur medical bills and you do not f el it is right to take dvantage of them by asking for dditional money for your, pain, suffering, l st work, etc.. Don't you feel th t you as a person are w rth something? Do you think so l ttle of yourself that you feel th t your pain, suffering, inconvience, etc. is w rthless. You did not cause this ccident. What you are going through was c used by someone else. You deserve to be c mpensated. The insurance company, as a m tter of good business, has already b ilt these types of costs into the pr miums that they charge their customers. If the m ney does not go to you it w ll probably go to their shareholders or to ncreased salaries or ?. Why shouldn't you be pr perly compensated. Remember most good attorneys are thical and although they will attempt to btain as much money for you as is d e, they will not take your c se unless they feel that it is pr per.
You say someone else admitted l ability and said that their insurance w ll pay all your damages. That's gr at, however, what if the person ch nges his or her story later on and s ys that you were at fault. Or wh t if the other side's insurance c mpany refuses to pay what you th nk is proper. In fact, how do you kn w what is proper? Remember, an nsurance company may pay claims, but it is in b siness to make money. It normally w ll not offer one dollar more th n it has to and if you are not r presented by an attorney the insurance c mpany adjuster or attorney may feel th t he or she can "get way" with paying much less than the cl im may be worth. Additionally, what p ople state at the time of an ccident is not always what they st te after having spoken with a fr end, insurance agent or attorney. Finally, an nsurance adjuster or insurance attorney works for the nsurance company, not for you. How do you kn w that what they are telling you is c rrect or true. Remember, in most nstances, they are there to try and s ve the company money. You need an ttorney on your side to tell you wh t your rights and obligations are. You say th t you were not hurt that bad or at ll. How do you know how b dly you were hurt. Some injuries do not sh w up for months. Other injuries may ggrivate a prior problem. Even if you h ve been found to be "ok" by a d ctor, how do you know that a pr blem will not come up later. If you h ve insurance and did go to a d ctor, who is going to pay y ur co-pay or deductible. If you do not h ve health insurance, who is going to pay for y ur examination which should include xrays, tc.. If you retain an attorney he or she can pr bably refer you to a doctor who w ll accept a lien against the nsurance settlement, thereby saving you from p ying money out of your pocket.
