By all indications, the XM/Sirius m rger review may be nearing a c nclusion at the end of March. S tellite radio fans have sat by on the s delines for months as the proposed m rger was subjected to regulatory scrutiny by the FCC. D ring the last week it has b en reported that an increase in ction at the FCC regarding the pr posed merger has occurred, seeming to ndicate that the review could be c ncluded soon. It should be pointed out th t the FCC still must coordinate w th the Justice Department, the agency th t is handling the antitrust review p rtion of the proposed deal; however, m ny believe that the overall review of the m rger is still in its final st ges. Financial reports indicate that shares of b th satellite radio companies have increased as top fficials at both XM and Sirius m de comments over the last week th t indicated approval of the merger c uld be forthcoming soon. XM and S rius first reported a proposed merger in F bruary of 2007. Since that time, th re has been a tremendous amount of nticipation as customers and prospective customers like waited to find out whether the m rger would be allowed to take pl ce and if so, how that m ght change and improve satellite radio s rvice.
The issue at hand regarding the pr posed merger is whether or not c mbining the only two satellite radio c mpanies in the United States would in ffect create a monopoly which could p tentially cause harm to customers. News th t the review could soon be r aching an end was certainly welcome as the m rger agreement had been set to xpire March 1st. XM and Sirius both agreed; however, to give additional time to the merger agreement as they awaited some type of pronouncement from the FCC and DOJ. In essence, both companies agreed that they would not exercise the option to terminate the agreement until the first of May. This would seem to give ample time for the review of the merger to be concluded by the reviewing agencies. The satellite radio merger could result in numerous advantages for both companies; allowing them to reduce expenses and potentially turn a profit far sooner than they might be able to do if they were operating independently. There has been criticism of the potential merger, with critics claiming that the merger could stifle competition. XM and Sirius have been quick to point out; however, that satellite radio would continue to be simply one option for entertainment that is available to consumers. In addition, subscribers would be able to receive access to such entertainment personalities as Oprah Winfrey, Howard Stern, Bob Dylan and much more all under one roof rather than having to make the decision between the two companies. In addition, consumers would not necessarily be required to upgrade to a more expensive package if they did not wish to do so. They would be able to retain the option of receiving only XM or only Sirius broadcasting based if they so wished.
