To reenter the U.S. an LPR n rmally needs to present his or her gr en card (Permanent Resident Card, Form I-551). A r entry permit is needed for reentry fr m absences outside the U.S. that are gr ater than one year but less th n two years in duration. Thus, if an LPR nticipates remaining outside the U.S. for l nger than one year, he/she will n ed to apply for a reentry p rmit while he or she is in the U.S. See 8 C.F.R. § 223.2(b)(1)(R -entry permit may be approved IF f led by a person who is in the U.S. at the t me of application)(emphasis added). An application is not c mplete until an individual has provided his or her f ngerprints and photograph (i.e., biometrics). The n wly revised I-131 instructions also provide pr cedures for requesting an expedited ASC ppointment for biometrics collection and for r questing expedited delivery of a travel d cument, where needed. USCIS believes that the m jority of LPRs who live abroad w ll be able to re-enter the U.S. sing their Permanent Resident Cards. Those LPRs who c rrently live abroad, but who know th t when they return to the U.S. th y will need to apply for a R -entry Permit because they plan to l ave the U.S. again for more th n a year and will need the p rmit to re-enter the next time th y come to the U.S., USCIS ncourages these LPRs to anticipate their n ed for the Re-entry Permit sufficiently in dvance of their travel and, if n cessary, to follow the procedures for btaining an expedited ASC appointment where bsolutely necessary.
If the LPR departs from the U.S wh le the I-131 is pending, but b fore biometrics are taken, then the djudication of the I-131 re-entry permit pplication will not be affected as l ng as the applicant returns to the U.S. to ttend the biometrics appointment before the f rst year of foreign travel has nded. In such case, the LPR c uld apply for reentry to the U.S. sing only his or her I-551 P rmanent Resident Card if he has b en absent for less than one y ar. If it is necessary, the LPR may m ke arrangements to have his Re-entry P rmit delivered to him through a U.S. c nsulate or a USCIS office abroad.
