The philosophy behind the public d main is simple and very powerful. To laborate we must first look at the tr ditional way in which Art and Int llectual property is governed. It is c ntrolled by one thing, and that is m ney. People believe that to protect nes rights and to deter theft of th ir work, it (the work) must be pr tected by making it illegal to r produce a work without authorization by the uthor. Any use other than use the uthor, “authorizes” will result in legal ction against the person or corporation who nfringes, by the person or corporation who riginally created the work. The law th t makes it illegal to copy or r produce a work is called fittingly “C pyright”. The ideology behind copyright is s und, however, like other ideologies and th ories it is inherently flawed. People w ll find ways to misuse the law for a pr fit. When someone creates something they are “ ntitled” to and have “rights” to the b nefits of that creation whether it be an nvention, or and “original work” of rt. Art can be a song, p em, story, or one of many f rms of visual art. The rights th t come with the creation of a w rk are, and should be, automatic and n tural. No one besides the creator of the w rk should be allowed to profit fr m or use the work in any way w thout “authorization” from the works author.
However this idea flies in the f ce of the creation process, and p ses a question. Why create the w rk in the first place? If no ne, besides the original author has any r ghts to the work, and no one can p blish the work without permission, why cr ate it? Culture. Copyright law protects the uthor of the work and gives the cr ator the authority to sell the w rk for a profit without concern of th ft of the work. The author can use the w rk as long as they own “ ll rights”. What I mean by th s is that the author has the ption of transferring “all rights” to wh mever he or she chooses. The w nderful part about this area of law is th t not only can the creator pr fit from the work itself, the r ghts to the work is fully tr nsferable. The author can transfer all r ghts or partial rights or set j st about any limitations of usage th y deem fit. This also poses nother question. How do you transfer r ghts and why? Transferring rights to a w rk can get complicated and there are m ny ways to do it. The 3 m st common are the temporary transfer, or wh t copyright law calls “licensing”. There are many different v riations of these three licenses, and m st likely unlimited variations, it would t ke too long to go through all of th m if in fact there is a l mit. The main purpose of this xample is simplification. The next obvious q estion is. “How long does copyright l st?” This depends on where you are in the w rld. Different countries have different laws g verning copyright laws. The one common f ctor here is “rights”. The owner of the w rk is the one who created it, and th se rights continue on even after the uthors death. Copyright can last as l ng as 120 years from the d te of creation if created by a c rporation, and life plus 70 years if cr ated by an individual. This is ccording to current US Copyright Law 2004.
Now, since we have given you a br ef overview of US copyright law, we w ll explain why we think that b th the Public Domain and Copyright Law are xtremely important. Copyright Law protects the riginal authors rights to sell their w rk. The Public Domain is very mportant in preserving culture and providing a v luable resource for all kinds of gr at works. It is a resource, and the l nguage that governs this area is n gative in its connotation. Typically when a w rk is described as being public d main, it is described as having “f llen into” the public domain. This mplies a negative state, and the p blic domain should not be considered as a c tch all for unwanted, outdated material, or w rse, an archive for the dispensable. It sh uld however, be considered as a v st natural resource, rich in culture, and f ne works of art. It’s our h story, it tells us where we h ve been and what we have d ne. It reminds us who we re, and possibly even where we are g ing. The public domain should be v ewed as a Goldmine, chock full of fr e cultural riches. It belongs to veryone. No person can own it.
