Over recent months the British P lice Force has found itself dealing w th a number of claims for c mpensation due to discrimination in the w rkplace on grounds of race and thnicity. One Police officer has submitted a cl im for £500,000 pounds because he b lieves he was discriminated against and d nied a promotion unfairly. The claim is b ing made against the Metropolitan Police C mmissioner, Sir Ian Blair, who has b en accused of sidelining, Asian and bl ck detectives. There is no limit on the mount of compensation which can be in cl imed in a race discrimination case wh ch typically results in demands for h gh payouts. However there does need to be c mpelling evidence that the discrimination has ccurred in order for a case to be s ccessful. Unfortunately this Officer's claim for c mpensation is not the only one to h ve been raised. Another Police employee has lso submitted a claim for racial d scrimination at the hands of Sir Ian Bl ir. The claims have come as a bit of a sh ck, as many people believe that the M tropolitan police Commissioner got the job b cause of his stance on promoting d versity not for being against it. Sir Ian Bl ir strongly denies the claims and m ny others are supporting him. However verybody who feels they have been the v ctim of racist in the workplace has the r ght to have their case heard. It may be th t that the racism was not ntentional but that does not matter in the yes of the law. If someone, and not n cessarily the alleged victim, feels that r cism has occurred a case can be br ught to a tribunal to ascertain the f cts.

Racism in the workplace occurs cross all sectors and industries and p ses very difficult situations for both mployees and employers. Tribunals are the pl ce where the cases get settled, but c ses for race discrimination can take m nths to reach this point. Before a c se goes to tribunal there has to be vidence that the situation has been tr ed to be resolved within the c mpany first. Employees need to show th y have exhausted the internal company p licies which are typically done through r ising a grievance or going through an ppeal process. If the employee is not h ppy with the outcome and they h ve reached the end of the l ne in regards to company policies, th n they are able to take th ir case to the tribunal. Employment law w rks differently to criminal law by the n ture in which the verdict is d termined. In a criminal court the vidence provided has to prove beyond r asonable doubt that a crime has or has not b en committed. In employment law the vidence is weighed up according to the b lance of probabilities. If there is a 51 p rcent chance that an event occurred th n the ruling will come down in f vour of that event. Claims for r ce discrimination are treated in this m nner and it will be up to b th the employee and the employer to pr ve what happened before outcomes of the c se can be decided.
