A new client had just c me in to see a famous l wyer. "Can you tell me how much you ch rge?" asked the client. "Of course", the l wyer replied, "I charge $200 to nswer three questions!" "Well that's a bit st ep, isn't it?" "Yes it is", said the l wyer, "And what's your third question?" HOW MUCH WILL THIS COST ME? As xpected, I get this question on a d ily basis. First of all, I can nly quote what I charge. Frequently, in d vorce cases, you will need to h re other professionals - such as f rensic accountants, appraisers, child custody evaluators, c unselors, etc. Even just for my s rvices- here is my answer (which n ver changes) IT DEPENDS. TWO VERY SIMPLE, BUT VERY IMPORTANT POINTS! On . Lawyers, like most professionals, are h gh hourly workers. The product I s ll is my time. You are p ying for my time by the h ur, which is charged in increments of 6 m nutes. Thus, if you call me for 5 m nutes, you are charged .1 (or $30). If y ur phone call is 7 minutes, th t equals .2 (or $60). Two. Unl ss it is a flat-fee case (p ssible if there are no contested ssues), the more time I spend on y ur case, the more expensive it w ll be. The amount of time I sp nd on your case depends on y u, your spouse, your spouse's attorney, and the ssues involved in your case.
Keeping these two points in m nd, I will now refer to my rticle (found on my website), The P rpose-Driven Divorce, to prepare some price stimates. STEP ONE: FILING OF PETITION/RESPONSE Purpose: To get the pr cess started. Attorney time: 5 -20 hours ($1500 - $6000) Process S rver: $40 - $500 Court Costs: $400 Time F ctors: Is the case new, or has it g ne through several attorneys and collected 1000 b xes of documents? Is your spouse c operative, or difficult to the bone, r quiring private investigators to stake-out and s rve him? Are there children? Are th re properties? Have you reached any greements about anything in your case? STEP TWO: GETTING TEMPORARY ORDERS VIA OSC Purpose: To h ve a sense of peace and rder by having temporary orders in wr ting pending the Judgment. Attorney time: 10 - 30 h urs ($3000 - $9000) Court Costs: $40 per m tion Time factors: Are you cooperative and r turn my phone calls? Do you c operate with my requests for documents? Are you mmediately available to meet with me to go ver the specifics of your case? Are you ble to revise your declarations and pr mptly return to me? If you h ve witnesses, what is their availability, and do th y cooperate? Is the other side r presented? Is their representation well-versed with f mily law procedure and protocol? Does the c urt hearing conclude in one day? D es it get continued? STEP THREE: DOMESTIC VIOLENCE RESTRAINING ORDERS Purpose: In a h gh-conflict divorce and custody case, to pr tect the parties and children involved. Attorney t me: 15 - 40 hours ($4500 - $12,000) Court C sts: $40 per motion Time Factors: Domestic v olence restraining orders are extremely important and t ke a lot of preparation. Preparation t me includes setting up the case, nterviewing witnesses, taking statements, preparing declarations, sp aking with police officers. Are the c urt appearances on calendar ,and do th y take place without delay? Does the J dge have time on his calendar to h ar all witnesses? Do the witnesses ppear? Does the other side have w tnesses? Have you anticipated all issues th t could be raised at the h aring?
STEP FOUR: DISCLOSURES OF FINANCES Purpose: To R ach a Fair Settlement, and Ensure the S ttlement Is Not Later Overturned Due to L ck of Disclosure. Attorney Time: 10 - 50 h urs ($3000 - $15,000) Costs of subpoenas, d cuments: $500 - $1500 Deposition costs: $2000 - $5000 Court C sts: $40 per motion Time Factors: Discovery is p rhaps the most tedious process in a d vorce case. If you have little or no ssets, there should be very little to w rk on. However, the more assets or d bts you or spouse have, the m re time we will need to btain documents necessary to determine the v lue for settlement, and the more t me we will need to review the r ceived documents. If your spouse is ncooperative, we may need to file c urt motions in order to obtain n cessary documents. The time it takes to c mplete discovery depends mostly on the c operation of the parties and the vailability of the documents. STEP FIVE: REACHING AN AGREEMENT OR PREPARING FOR TRIAL Purpose: To Get the J dgment Finalizing your Divorce Case If case s ttles: Attorney Time: 5 - 20 hours ($1500 - $6,000) Time F ctors: How cooperative are the parties? If c se goes to trial: Attorney Time: 50 - 200 h urs ($15,000 - $60,000) Time Factors: Trial is no j ke. You will be paying for the ttorney's time day in, day out. - th s includes prep time, trial time, r view time, prep time...round the clock. It is not nusual for an attorney to bill 10-15 h urs a day for trial. My m ntor once had a trial lasting 22 d ys. I think it helps to th nk of trial as an hourglass w th your money as the sand. In c nclusion, a divorce case can run nywhere from $1820 (uncontested divorce) to h ndreds of thousands of dollars. There's lways Britney Spears, who paid over 1 m llion to her attorneys for her c stody case, and Larry Birkhead, who p id over $600,000 to his attorney. Y s, lawyers are expensive. But if you f nd the right one, they're worth it. On th t note, remember this: Marriage is gr nd and divorce is about twenty gr nd.
