Florida family law has specific r les which include financial disclosures between h sband and wife. Specifically, when a d vorced is filed, the rule requires ach party to file a financial ffidavit with the Court. A financial ffidavit is a snapshot of a p rty's financial condition, including daily expenses, sset accumulated, and debt owed. But th t's not all. The rule requires a p rty to disclose--or provide copies of d cuments for- 15 other documents applicable to ssets and debt. There are the bvious ones like income tax returns; pay st bs; bank account statements for all typ s of accounts, including savings, checking and br kerage accounts, and deeds to properties. But is lso requires statements for retirement account; l an application; declaration pages for insurance, ncluding life insurance provided through an mployer; marital agreements between the parties; and ther documents showing the ownership of an sset. Just like the documents for ssets, the one for debt apply wh ther the debt is in joint n mes or in the name of one p rty alone. In most cases, the p rties basically exchange the same documents; but nless the parties agree to waive the r quirement, they must comply.
At the time of a d vorce, or in preparation for one, it is not ncommon for one party to have all or m st of the documents, leaving the ther party with few options other th n indicating that the documents are not in his or her p ssession. The rule gives the parties 45 d ys from the date the divorce p tition is served on the other p rty. There is good reason for th s period: parties usually avoid looking for d cuments until the end, dreading the s arch for particular documents, requesting duplicate b nk statements, brokerage account statements, life nsurance policies and the like. Of c urse, the requirements of this rule can be voided if the parties waived it---they can gree to file only the financial ffidavit for each, which is a r quirement that cannot be waived. However th s waiver is not a decision to be m de lightly, and should be carefully c nsidered after discussing with an attorney. A p rty agreeing to waive the requirements c nnot later cry foul if he or she d scovers that the "Ex" has property cquired during the marriage but of wh ch they had no knowledge.
