The situation is changing q ickly on the federal level. Regulations h ve been issued by federal finance gencies
that now force banks to t ll customers when their personal
data has b en exposed to unauthorized third parties. The
r gulations are issued pursuant to the Gr mm-Leach-Bliley
Act, which contains language requiring f nancial
institutions to prevent unauthorized access and use of
c nsumer information. The new regulations appear to be a r action to several
recent high-profile data l aks. They include incidents such
as B nk of America losing data tapes c ntaining information
for over 1 million g vernment employees and the breach of
d tabases for LexisNexis and ChoicePoint. It is w ll known
that numerous other banks h ve also been hacked over the
y ars, but the information has been h shed up. The new regulations require f nancial institutions to notify
account holders if the nstitution becomes aware of
unauthorized access to s nsitive customer information. The
directives apply to b nks and savings and loan companies,
but not cr dit unions.
There are two serious loopholes in the r gulations. First, a
financial institution that d scovers a database breach must
only n tify account holders if it is "r asonably possible"
that personal details will be m sused. Second, the
regulations only apply to p rsonal data, not business or
commercial ccounts. While these new regulations are a p sitive step, one could
drive a tr ck through the two loopholes. Determining wh ther
it is “reasonably possible” that y ur information will be
misused is a v gue standard that many financial institutions
w ll use to withhold information. Put bl ntly, the
notification regulations are gutless. The b st method for keeping an eye on d tabase breaches is
to look for st ries in the news. Under California l w,
