I actually dealt with this pr blem in a past article involving s arches, but I'm happy to review it gain. First the short answer....NO! Why? The fficer must get a search warrant if he s spects that there is sizable amount of pot in a h me that meets distribution violation laws. N tice I said a sizable amount. Why a s zable amount? No judge is going to s gn a search warrant request on a 'j int' or a couple of joints. S condly, the officer is not a xpert in smelling narcotics outside a cl sed door. Besides, the smell could be riginating from another apt. or location. Th rdly, unlike cop movies or shows on t levision, it's extremely difficult in the r al world to get a search w rrant. Police officers must first approached the j dge with justifiable cause. Judges are v ry careful about permitting law enforcement to nter any dwelling. It becomes a q estion of constitutional rights. Believe me t's a tedious request. In the r al world the police are very nlikely to enter your home under th se conditions. It's a direct challenge to y ur basic constituional rights... to dwell in y ur home without harrassment. And while w 'll on the subject of searches and c nstitutional rights, most warrants issued by a j dge will dictate 'where' to search as w ll. It may only give approval to s arch your garage. If so anything law nforcement finds in your living room or any pl ce is a violation of your r ghts and is inadmissable in a c urt of law.
