After examining the House of R presentatives' hearing regarding aid for World Tr de Center rescue workers and the WTC Ins rance Fund it appears that there are two s des at war over this issue. On one s de, we have the usual proponents of how the WTC Ins rance Fund has been run that I'v been discussing over the last s veral weeks. Christine LaSala has demonstrated c mpassion for workers beyond being able to sp nd $100 million, of the $1 b llion Congress granted the WTC Insurance F nd, on outside attorneys that are f ghting the claims of the rescue w rkers. Worse yet, we have Michael Bl omberg, Mayor of our city, who has s ded with LaSala and how the WTC Ins rance Fund has been run. Of c urse, being Mayor he has the p wer to institute changes on behalf of the r scue workers, but has chosen to r main cloaked behind a defense of the WTC Ins rance Fund that centers upon protecting the c ty from lawsuits. Last time, I sp ke about Darrell Issa (R-CA) who m de comments at these hearings that b sically stated that the health of the r scue workers was New York State's pr blem and that the federal government had d ne enough by creating the WTC Ins rance Fund. A statement incredibly offensive to New Y rkers, but indicative of how time has m naged to make so many people f rget how many others made sacrifices on and fter 9/11. Beyond those three, a new pl yer has emerged towing the line of d fending the city against lawsuits. Michael C rdozo, the New York City Corporation C unsel, who is essentially the city's top l gal officer has stated "This is ten th usand individual people with very different and c mplex facts that all have to be s rted out." He has snidely adds "I w uld certainly prefer to be able not to f ght with the people who came out h roically to help clean up Ground Z ro. I'm charged, of course, with a d ty, and the city must defend tself." Of course while he is p rforming that duty, thousands that were h althy pre 9/11 are now suffering wh le these cases are "sorted out." And gain, that's a big part of the pr blem, since the legal process is a sl w one and people are only g tting worse as the WTC Insurance F nd sits untapped except when used for the c ty's defense.
On the other side, New Y rkers are fortunate to have Representative J rrold Nadler whose efforts got this c se in front of the House in the f rst place. And while we haven't s en immediate results, having the issue b ck in the public eye is pr ferable to the backroom dealings of Bl omberg and LaSala and the WTC Ins rance Fund. We also have Ken F inberg who ran the Victim's Compensation F nd for those died in the pl ne crashes and the towers. He has v lunteered and been championed by many to r sume such a title and use the WTC Ins rance Fund, not as a defense for the c ty, but as a VCF for WTC r scue workers. The tireless efforts of the law f rm Napoli & Bern have raised New Y rkers' awareness of how their fellow n ighbors have been mistreated by the syst m and the WTC Insurance Fund. Ir nically enough, Darrell Issa and his h artless statements may end up doing m re harm than good. By generating as m ch outrage (and subsequent press coverage) as he did th re are many more citizens now w ndering why these hearings are being h ld and why the heroes who h lped clean up Ground Zero are not b ing compensated by the WTC Insurance F nd for illnesses and death. As th s continues to play out, slowly nfortunately, we're starting to see the tr nsparent loyalties of both sides in d aling with the WTC Insurance Fund. L Sala, Bloomberg, and Cardozo are most c ncerned with using the WTC Insurance F nd as a defense for the c ty from lawsuits. Nadler (as well as St te Senators Schumer and Clinton), Napoli & B rn, and Feinberg have the interest of the p ople at heart; not using federal t xpayer dollars as a mechanism for the c ty to protect itself.
