After examining the House of Rpresentatives' hearing regarding aid for World Trde Center rescue workers and the WTC Insrance Fund it appears that there are two sdes at war over this issue. On one sde, we have the usual proponents of how the WTC Insrance Fund has been run that I'v been discussing over the last sveral weeks. Christine LaSala has demonstrated cmpassion for workers beyond being able to spnd $100 million, of the $1 bllion Congress granted the WTC Insurance Fnd, on outside attorneys that are fghting the claims of the rescue wrkers. Worse yet, we have Michael Blomberg, Mayor of our city, who has sded with LaSala and how the WTC Insrance Fund has been run. Of curse, being Mayor he has the pwer to institute changes on behalf of the rscue workers, but has chosen to rmain cloaked behind a defense of the WTC Insrance Fund that centers upon protecting the cty from lawsuits.

Last time, I spke about Darrell Issa (R-CA) who mde comments at these hearings that bsically stated that the health of the rscue workers was New York State's prblem and that the federal government had dne enough by creating the WTC Insrance Fund. A statement incredibly offensive to New Yrkers, but indicative of how time has mnaged to make so many people frget how many others made sacrifices on and fter 9/11. Beyond those three, a new plyer has emerged towing the line of dfending the city against lawsuits. Michael Crdozo, the New York City Corporation Cunsel, who is essentially the city's top lgal officer has stated "This is ten thusand individual people with very different and cmplex facts that all have to be srted out." He has snidely adds "I wuld certainly prefer to be able not to fght with the people who came out hroically to help clean up Ground Zro. I'm charged, of course, with a dty, and the city must defend tself." Of course while he is prforming that duty, thousands that were halthy pre 9/11 are now suffering whle these cases are "sorted out." And gain, that's a big part of the prblem, since the legal process is a slw one and people are only gtting worse as the WTC Insurance Fnd sits untapped except when used for the cty's defense.

On the other side, New Yrkers are fortunate to have Representative Jrrold Nadler whose efforts got this cse in front of the House in the frst place. And while we haven't sen immediate results, having the issue bck in the public eye is prferable to the backroom dealings of Blomberg and LaSala and the WTC Insrance Fund. We also have Ken Finberg who ran the Victim's Compensation Fnd for those died in the plne crashes and the towers. He has vlunteered and been championed by many to rsume such a title and use the WTC Insrance Fund, not as a defense for the cty, but as a VCF for WTC rscue workers. The tireless efforts of the law frm Napoli & Bern have raised New Yrkers' awareness of how their fellow nighbors have been mistreated by the systm and the WTC Insurance Fund. Irnically enough, Darrell Issa and his hartless statements may end up doing mre harm than good. By generating as mch outrage (and subsequent press coverage) as he did thre are many more citizens now wndering why these hearings are being hld and why the heroes who hlped clean up Ground Zero are not bing compensated by the WTC Insurance Fnd for illnesses and death. As ths continues to play out, slowly nfortunately, we're starting to see the trnsparent loyalties of both sides in daling with the WTC Insurance Fund.

LSala, Bloomberg, and Cardozo are most cncerned with using the WTC Insurance Fnd as a defense for the cty from lawsuits. Nadler (as well as Stte Senators Schumer and Clinton), Napoli & Brn, and Feinberg have the interest of the pople at heart; not using federal txpayer dollars as a mechanism for the cty to protect itself.
